Terms of Service

Agreement

By purchasing hardware from or creating an account with Bluegum Systems Pty Ltd ("Bluegum", "we", "us"), you agree to these Terms of Service. If you don't agree, don't use the service.

These terms are governed by the laws of Queensland, Australia. Any disputes will be heard in the courts of Queensland.

The service

Cobalt provides:

  • Hardware — the Cobalt Hub V2 and associated sensor peripherals, sold as a one-time purchase.
  • Software platform — a cloud dashboard, alerting system, and API for accessing your sensor data, provided on a monthly subscription basis.

The hardware purchase includes your first month of platform access. After that, you'll be billed $10 AUD/month to continue cloud access. You can cancel at any time.

Hardware purchase

Hardware is sold subject to Australian Consumer Law (ACL). Your statutory rights as a consumer are not limited or excluded by these terms.

We provide a 12-month warranty against manufacturing defects. This does not cover physical damage, water ingress beyond the rated protection level, or misuse. To make a warranty claim, contact us at support@bluegum.systems.

We currently ship within Australia only. Shipping times are estimates and not guaranteed. Risk of loss transfers to you once the goods are dispatched.

Subscription and billing

Subscriptions are billed monthly. Payment is processed by Stripe. By subscribing, you authorise recurring charges to your payment method.

You may cancel at any time via your account settings or by emailing us. Cancellation takes effect at the end of your current billing period — you won't be charged again, and you'll retain access until that period ends.

We reserve the right to change subscription pricing. We will give you at least 30 days' notice by email before any price change takes effect. If you don't want to continue at the new price, you can cancel before the change applies.

Refunds

Hardware refunds are available within 30 days of receipt for undamaged, unused items returned in original packaging. Return shipping is at your cost unless the item is faulty.

Monthly subscription fees are non-refundable once a billing period has started, except where required by Australian Consumer Law. If you believe you are entitled to a refund under ACL, contact us.

Your data

You own your sensor data. We store it on your behalf. You may export it at any time via the dashboard or API.

If your subscription lapses, we will retain your data for 90 days before permanent deletion. We will email you before deletion occurs. Reactivating your subscription within that window restores full access.

Acceptable use

You must not:

  • Use the platform for any unlawful purpose
  • Attempt to gain unauthorised access to other users' data or our systems
  • Reverse engineer the hardware or firmware beyond what is permitted by law
  • Resell access to the platform without our written permission
  • Submit data at rates that unreasonably burden our infrastructure

We may suspend or terminate accounts that violate these terms, with or without notice depending on the severity.

Availability and uptime

We aim for 99.9% uptime on the cloud platform but do not guarantee it. We may take the service offline for maintenance with reasonable notice. Sensor hubs continue to cache data locally during any outage and sync automatically when service is restored.

We are not liable for losses caused by platform unavailability. Our total liability to you in any 12-month period is capped at the amount you paid us in subscription fees during that period.

Limitation of liability

To the extent permitted by law, Cobalt is not liable for any indirect, incidental, or consequential loss arising from your use of the service — including but not limited to data loss, stock spoilage, equipment damage, or business interruption.

Nothing in these terms excludes or limits liability for death, personal injury, fraud, or any liability that cannot lawfully be excluded under Australian Consumer Law.

Changes to these terms

We may update these terms from time to time. For material changes, we will notify you by email at least 14 days before the changes take effect. Continued use of the service after that date constitutes acceptance. If you do not agree to the updated terms, you should cancel your subscription before they take effect.
